Acceptance
By using outthere.nyc (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. You also agree to our Privacy Policy.
What Out There NYC is
Out There NYC is a discovery layer for in-person singles events in the New York City metro area. We curate and organize information about events run by third parties and link out to those third-party sites for tickets, registration, and attendance. We are not the host, operator, ticket vendor, or guarantor of any event listed.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By creating an account, you confirm that the information you provide is accurate.
Your account
You are responsible for the security of your account credentials and all activity under your account. Notify us at hello@outthere.nyc if you suspect unauthorized access. You may delete your account at any time from your settings.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to harass other people.
- Scrape, crawl, copy, or harvest data from the Service except as expressly permitted.
- Misrepresent your identity or impersonate another person or organization.
- Attempt to interfere with the Service’s security, availability, or integrity.
- Use automated systems to access the Service without our written consent.
We may suspend or terminate accounts that violate these rules.
Third-party events and links
Events listed on Out There NYC are operated by independent third parties. We do not screen, endorse, or vouch for any organizer, venue, or attendee. We are not responsible for:
- The accuracy of event details (time, location, price, capacity).
- The quality, safety, or conduct at any event.
- Refunds, cancellations, or disputes with third-party ticket platforms.
- Interactions or relationships formed at or through any event.
You attend events at your own risk and are responsible for your own safety and judgment.
Intellectual property
The Service’s design, code, content, and brand are owned by Out There NYC or our licensors. You may not copy, modify, distribute, or create derivative works from the Service without our written permission, except for personal, non-commercial use within the Service as intended.
Event details (names, descriptions, images) are sourced from organizers and remain the property of those organizers.
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that event information is current or accurate.
Limitation of liability
To the maximum extent permitted by law, Out There NYC, its operators, and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or attendance at any event discovered through the Service. Our total liability for any claim is limited to the greater of $100 USD or the amount you paid us in the twelve months before the claim arose.
Indemnification
You agree to indemnify and hold Out There NYC and its operators harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will do so.
Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be communicated via email or a notice on the site at least seven days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
